Any tour packages you purchase using this web site, which is confirmed in accordance with these terms and conditions, will constitute a legal agreement between you and the tour operator, carrier, hotel, or other travel supplier.

Use Of This Web Site
You may only use this web site for your own personal use. By using this site, you agree to be bound by the terms listed below. If you do not agree to be bound, you must leave this site now or contact us further at ingwest@ingwest.com.au.

Agent only
Ingwest acts as agent for third party suppliers such as airlines, car hire, hotels, insurance companies, transportation suppliers, and others (Travel Supplier). Ingwest Pty Ltd acts as agent only and will not be responsible for providing your holidays or tours. When you make a booking via the web site, and your preferred travel product or service is available, the contract will be between the Travel Supplier and you. Ingwest is not a party to the contractual relationship.

Ingwest and Supplier's Travel Services and Information
Ingwest offers our travel products and services to suit your business or leisure needs. We are able to book flights, hotel accomodation, rental cars, travel insurance, tours and other such services. Ingwest offers you a preview of some of our services via this web site. We also display general information about travel within Australia and New Zealand, including destination guides. We may also display information about airfares, flight times and dates, tours, packages, insurance, cruises, transportation, foreign currency, schedules, weather, travel companies and many other things.
You understand, acknowledge, and agree to the following:
Ingwest does not assume any responsibility for the travel products and services provided by the Travel Supplier and makes no representations or warranties (express or implied) about the suitability or quality of travel products and services featured on the Site.
Currency rates provided by us through our currency rate provider, are derived from a variety of publicly available sources, and they reserve the right to change their sources at any time without notice. Although they strive to ensure their figures are correct, they can make no guarantees as to their accuracy or suitability for any purpose. While effort is taken to ensure their accuracy, errors can from time to time appear. Currency rates specified by financial institutions will differ from our provider's, sometimes significantly. In addition, currency rates will vary by geographical market. The end user assumes all risk for the use of any information provided by our services. The details of the prices, packages, tours, flights and other information displayed on the website are subject to change without notice. The travel products and services described on the website are subject to availability.
 

User Obligations
You agree to be bound by the following obligations, including without limitation:

You should ensure that you satisfy yourself of the suitability of the activity prior to choosing you experience and if necessary seek specialist medical advice. Ingwest Pty Ltd shall be under no liability to you for any bodily injury, property damage or loss you may suffer except in regard to any rights you may have arising under the Trade Practices Act, 1974.

We do not represent that any travel products and services set out on our web site or presented to you via email correspondence will be suitable for you. You release us from any claims in relation to the travel products and services described on our web site, in periodic newsletters, and email correspondences, including but not limited to claims that the travel products and services are not suitable.

Ingwest, its officers, employees and agents, ("we/us") are not liable to you or to anyone else for any loss that occurs in connection with the use of this web site or a linked web site. This includes any loss or damage, including damage from malicious or faulty computer programs, caused by any reason (including negligence), whether suffered as a direct or indirect result of the use of this site.

Whenever possible, we will update the information present on this web site, however this may depend on such availability from the travel supplier. Pricing
All prices displayed on the website are subject to change without notice. This is because the airlines and other third party providers may change the prices at any time. Prices displayed are starting guide prices, which may not include room, flight supplements, taxes or airport charges. Taxes, airport charges and any additional costs will be advised to you once you have made a booking with us. All tour packages, flights, and other travel details are subject to availability and price changes prior to confirmation of your booking. A final costing will be provided once bookings are confirmed, but before payment is collected. Whilst we regularly update and check the price of all the tour packages and flights advertised, we cannot guarantee the availability of any tour package or flight at an advertised price. The prices shown are based on certain occupancy levels for the accommodation. Please check the correct price which will be made known to you before you book. The prices of holidays and flights are in Australian Dollars (AUD) usually inclusive of all taxes unless otherwise indicated. As with most travel companies, we charge a 2% per transaction handling fee, for payment by Visa, Mastercard, and 3.5% for American Express and Diners Club.

Cancellation
Once your tours are booked, it can be cancelled subject to payment of a cancellation charge. These charges are set by Ingwest and other tour operators/third party service providers in accordance with our/their booking conditions which govern the contract. Most cancellation charges are based on a sliding scale, with a percentage of the holiday cost payable in cancellation fees. This scale rises the closer to the date of departure that the holiday is cancelled. In some cases, if cancellation is made within the 24 hours period, you may be liable to pay all charges. Any cancellations must be made in writing to Ingwest, and this must be done as soon as possible by the person in whose name the booking was made. When doing so, please quote your reference number, name and relevant dates. In the event of cancellation, any charges may be covered by your Travel Insurance - please refer to your policy for more information.
